Terms of Use

These Terms of Use ("Terms") govern your use of the LanguaCards mobile application (the "App") operated by LanguaCards Ltd ("we", "us", or "our"). By downloading, installing, or using the App you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Eligibility

You must be at least 13 years old to use the App. If you are under the age of 18, you confirm that you have obtained consent from a parent or legal guardian to use the App and agree to these Terms.

2. Your account

• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate and up-to-date information when creating your account.
• You are responsible for all activity that occurs under your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Use of the App

You may use the App for personal, non-commercial language learning purposes. You agree not to:

• Copy, modify, distribute, or reverse-engineer the App or its content.
• Use the App for any unlawful or unauthorised purpose.
• Interfere with or disrupt the App's servers, networks, or infrastructure.
• Attempt to gain unauthorised access to other users' accounts or data.
• Upload or submit content that is offensive, defamatory, or infringes the rights of others.
• Use automated tools, bots, or scrapers to access the App.

4. Content and intellectual property

4.1 Our content

All vocabulary content, flashcard data, audio recordings, conjugation tables, design, graphics, and other materials provided through the App are owned by or licensed to LanguaCards Ltd and are protected by copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our prior written consent.

4.2 Your content

You retain ownership of custom vocabulary packs and flashcards you create within the App. By creating content in the App, you grant us a limited licence to store and display it to you as part of the service. Your custom content is private and is not shared with other users.

5. Subscriptions and payments

5.1 LanguaCards Pro

LanguaCards Pro is available as an auto-renewing subscription that unlocks additional features including all vocabulary packs, all conjugation tables, custom flashcard creation, and every CEFR level.

5.2 Billing

• Payment is charged to your Google Play or Apple App Store account at the time of purchase confirmation.
• Subscription prices are displayed in the App before purchase and may vary by region.
• Prices may change from time to time. Any price change will take effect at the start of your next billing period after the change.

5.3 Auto-renewal

• Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the same rate.

5.4 Managing and cancelling your subscription

You can manage or cancel your subscription at any time through your device's app store settings:

• Google Play: Open the Google Play Store app > tap your profile icon > Payments & subscriptions > Subscriptions > LanguaCards > Cancel subscription.
• Apple App Store: Open Settings > tap your name > Subscriptions > LanguaCards > Cancel Subscription.

Cancellation takes effect at the end of the current billing period. You will continue to have access to Pro features until your current period expires. Uninstalling the App does not cancel your subscription.

5.5 Refunds

Refund requests are handled by the app store through which you made the purchase:

• Google Play: You may request a refund through Google Play within the timeframe specified in Google Play's refund policy.
• Apple App Store: You may request a refund through Apple at reportaproblem.apple.com in accordance with Apple's Standard EULA.

We do not process refunds directly. All refund decisions are made by the respective app store.

5.6 Free trial

If a free trial is offered, it will be clearly stated before purchase. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the displayed price.

6. Availability and changes

We aim to keep the App available at all times but do not guarantee uninterrupted access. We may:

• Modify, update, or discontinue features at any time.
• Perform maintenance that temporarily limits availability.
• Discontinue the App entirely with reasonable notice.

7. Disclaimer of warranties

The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that:

• The App will meet your specific learning requirements.
• The App will be uninterrupted, timely, secure, or error-free.
• The vocabulary content or translations will be completely accurate in every context.

8. Limitation of liability

To the fullest extent permitted by law, LanguaCards Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising out of or in connection with your use of the App.

Our total liability for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater.

9. Indemnification

You agree to indemnify and hold harmless LanguaCards Ltd and its officers, directors, and employees from any claims, liabilities, damages, or expenses arising from your use of the App or your violation of these Terms.

10. Third-party services

The App integrates with third-party services including Google Play, Apple App Store, Firebase, RevenueCat, and PostHog. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

Your use of the App on Apple devices is also subject to Apple's Licensed Application End User License Agreement.

11. Termination

We may suspend or terminate your access to the App at any time if you breach these Terms. Upon termination:

• Your right to use the App will cease immediately.
• Any active subscription will continue until the end of the current billing period, but will not renew.
• We may delete your account data in accordance with our Privacy Policy.

12. Governing law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Material changes will be communicated through the App. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
